Terms of Service
1. Introduction
Welcome to Mazzy! These Terms of Service ("Terms") govern your use of our social app, website, and services ("Service"). By accessing or using our Service, you agree to comply with and be bound by these Terms.
2. Eligibility
You must be at least 21 years old and located in the United States to use Mazzy. By creating an account, you represent and warrant that you meet these requirements.
3. Account Registration
To use our Service, you must register and create an account by providing your First Name, Last Name, Email Address, Phone Number, State, Zip Code, a Photo, and a short bio. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Membership & Pricing
Plans: We offer annual membership plans. Annual subscriptions are $150 per year. During our pre-sale, payment will be collected but the membership plan will have a different start date based on when the app is available for use.
Billing Cycle: Subscriptions are annually one year after the original start date of the membership. 
Payment Methods: We accept payments via credit cards processed through Stripe.
5. Usage Guidelines
Acceptable Use: Users must use the service in compliance with all applicable laws and not for any unlawful purpose. Users are prohibited from posting any content that is illegal, offensive, defamatory, or infringes on the rights of others.
User Responsibilities: Users are responsible for ensuring that their content does not violate any laws or third-party rights. We reserve the right to remove content that violates these terms and to terminate the accounts of repeat offenders.
Prohibited Activities: Users may not use the Service to engage in any activity that is harmful, fraudulent, deceptive, or offensive. This includes, but is not limited to, harassment, bullying, impersonation, spamming, and the distribution of malware.
6. Content Ownership
Mazzy Content: All content created by and for Mazzy, including personalization algorithm, is owned by us.
User Content: Users retain ownership of their content but grant Mazzy a perpetual, non-exclusive, royalty-free, worldwide license to use, display, and distribute their content. Users are responsible for ensuring their content complies with these terms and all applicable laws.
Reporting Violations: Users can report violations of these Terms or any inappropriate content by contacting us through the provided support channels.
7. Termination and Cancellation
User Termination: Users may terminate their subscription at any time, but the termination will be effective at the end of the current billing period.
Refunds: We offer one full refund per customer up to 14 days after their first billing cycle. Pre-sales are non-refundable. 
Service Termination: We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason in our sole discretion.
8. Intellectual Property
Mazzy owns the proprietary personalization algorithm, all website and app, including blog posts, website copy, and app content. 
Trademarks: All trademarks, service marks, logos, trade names, and any other proprietary designations of Mazzy used herein are trademarks or registered trademarks of Mazzy.
9. Liability Limits
Disclaimer of Warranties: Mazzy is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.
Limitation of Liability: To the fullest extent permitted by law, Mazzy, its affiliates, officers, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
Cap on Liability: In no event shall the aggregate liability of Mazzy exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid Mazzy, if any, in the past six months for the services giving rise to the claim.
10. Dispute Resolution
Agreement to Arbitrate: You and Mazzy agree to resolve any disputes through final and binding arbitration, except as set forth under "Exceptions to Agreement to Arbitrate" below. This includes disputes arising from or relating to interpretation or application of this "Dispute Resolution" section, including its enforceability, revocability, or validity.
Arbitration Procedure: The arbitration will be conducted by the American Arbitration Association (AAA) under its rules and procedures, including the AAA's Consumer Arbitration Rules. The arbitration will be held in a mutually agreed location or via teleconference or videoconference.
Exceptions to Agreement to Arbitrate: Both you and Mazzy retain the right to bring an individual action in small claims court, and to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.
Waiver of Jury Trial: You and Mazzy waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury. You and Mazzy are instead electing to have claims and disputes resolved by arbitration.
Class Action Waiver: You and Mazzy agree to bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
11. Privacy Policy
1. Data Collection
Personal Information: When you register, we collect personal information such as your First Name, Last Name, Email Address, Phone Number, State, Zip Code, Photo, and bio.
Usage Data: We collect data on preferences, types of content, chats with others, likes, reactions, saves, and other interactions within the app.
2. Data Use and Protection
Usage: We use the data to personalize user experiences, improve our services, and communicate updates.
Protection: We implement industry-standard security measures to protect your data. This includes encryption, access controls, and secure data storage.
3. User Rights and Choices
Access and Correction: Users can access and correct their personal information through account settings.
Deletion: Users can delete their account at any time, and all personal data will be removed from our active databases.
Data Requests: Users can request a copy of their personal data we hold or ask for corrections by contacting us.
4. Compliance
GDPR: While primarily serving the US, we align with GDPR principles for data protection and user rights.
CCPA: We comply with CCPA requirements, providing California residents with rights to access and delete their personal data.
12. Communication
1. Changes to Terms
We will notify users of any changes to these Terms, our Privacy Policy, or other service updates via email. Users are encouraged to review these Terms periodically for any changes. Continued use of the Service after such changes constitutes acceptance of the new terms.
